ABSTRACT
Il contributo esplora la complessa evoluzione del diritto ebraico, dalla sua origine biblica fino alla modernità dello Stato di Israele. Attraverso l’analisi della dialettica tra Legge scritta e Legge orale, si evidenzia come il sistema giuridico ebraico abbia affrontato la transizione dalla tradizionale Halakhah al moderno Mishpat ‘ivri, con particolare attenzione alle tensioni emergenti nella definizione della soggettività giuridica e nei casi emblematici del matrimonio e del divorzio.
The paper explores the complex evolution of Jewish law from its biblical origin to the modernity of the State of Israel. Through an analysis of the dialectic between Written Law and Oral Law, it shows how the Jewish legal system has dealt with the transition from the traditional Halakhah to the modern Mishpat ‘ivri, with particular attention to emerging tensions in the definition of legal subjectivity and in the emblematic cases of marriage and divorce.
